Mischief Allegations in Ontario

Mischief is broader than physical destruction. The Criminal Code can capture wilfully damaging property, rendering it dangerous, useless, inoperative or ineffective, or obstructing, interrupting, or interfering with lawful use or enjoyment.


The Crown Must Connect the Accused to Wilful Conduct

The prosecution must prove identity, the prohibited conduct, the required mental element, and the property-related circumstances of the charge. Accident, authorization, honest misunderstanding, or lack of proof about causation may be important.
