Mischief Allegations in Ontario
Mischief is broader than physical destruction. The Criminal Code can capture wilfully damaging property, rendering it dangerous, useless, inoperative or ineffective, or obstructing, interrupting, or interfering with lawful use or enjoyment.
The Crown Must Connect the Accused to Wilful Conduct
The prosecution must prove identity, the prohibited conduct, the required mental element, and the property-related circumstances of the charge. Accident, authorization, honest misunderstanding, or lack of proof about causation may be important.
Evidence We Review
- Photographs, repair estimates, ownership and property-use records
- Surveillance, doorbell, phone, and social-media evidence
- Witness observations, prior disputes, timing, access, and alternative causes
- Statements, alleged admissions, intoxication evidence, and police notes
- Forensic evidence, tools, digital interference records, and continuity
Value and Type of Property Matter
The charge and possible consequences can be affected by the value and nature of the property and whether life was endangered, testamentary property was involved, or computer data was affected.
Collateral Effects Can Outlast the Case
A conviction may involve restitution, probation, fines, custody in serious cases, employment or immigration effects, and conditions restricting contact or attendance at a location.
