Possession Is More Than Proximity

The Crown must prove the elements of the charged offence. Being near an item is not always enough. Knowledge, consent, control, joint possession, purpose, and the reliability of police inferences may be disputed.

Can I be charged if drugs or a firearm belonged to someone else?

Yes, but the Crown must still prove the required knowledge and control. Ownership and legal possession are not always the same question.

Can police search my phone after arrest?

A phone search requires lawful authority and must stay within its permitted scope. The facts, timing, purpose, and any warrant are important.

Does a firearms licence answer every charge?

No. A licence does not necessarily answer allegations about storage, transport, prohibited devices, location, or compliance with a court order.
